A High Court decision in May 2016 made clear the court's support for the use of technology-assisted review in disclosure even where the parties are not in agreement. Following the court's recent judgment on the facts in that case, which relied heavily on the disclosed documents, it is timely to consider when it might be appropriate to use predictive coding in the context of disclosure, and the practical steps involved.
