Business Lease Code - the impact so far? | Practical Law

The Code for Leasing Business Premises in England and Wales 2007 (Business Lease Code) was published on 28 March 2007 with the objective of achieving a fairer balance between the landlord and the tenant, and a greater flexibility in commercial lease terms. If the Business Lease Code fails to change practice in England and Wales, the Government has said that it will intervene with legislation.

If the Business Lease Code fails to change practice in England and Wales, the Government has said that it will intervene with legislation.
PLC Property would like to invite you to a seminar where a panel of experienced property lawyers will examine the following aspects of the Business Lease Code and how they are working in practice:
A short introduction to the seminar will be given by Ian Fletcher of the British Property Federation.
The seminar is open to lawyers and their clients and to members of the British Property Federation.

Biographies of speakers

Ian Fletcher, British Property Federation

Ian Fletcher is the Director of Commercial and Residential Policy at the British Property Federation (BPF).
Ian's brief at the BPF covers a wide range of housing and landlord and tenant issues. His successes include the industry's campaign against possible legislative intervention on upward-only lease terms, work on the pan-industry campaign for REITs, and allowing collective investment schemes to invest in residential property via self-invested personal pensions.
Ian is a Board member of the National Approved Lettings Scheme (NALS) and sits on the London Mayor's Housing Forum and editorial board of ROOF – the housing magazine.
Ian joined the BPF in May 2002 from the British Chambers of Commerce (BCC), where he was Head of Policy and Chief Economist, representing the interests of Britain's small business community. Amongst his campaigning successes was the dropping of proposals for a supplementary business rate.
Ian started his working life in the small business section of what was then Midland Bank and also spent a year teaching. He holds professional qualifications in banking and market research.

Nick Darby, Denton Wilde Sapte

Nick Darby is a senior solicitor with Denton Wilde Sapte LLP.
Nick works in the Real Estate Department on a variety of commercial property matters. These include lettings and development agreements for retail occupiers, general commercial transactions, property management work and portfolio acquisition.
Nick is also involved with the British Retail Consortium, and was their legal representative on the DCLG Working Group that re-wrote the Business Lease Code.

William Juckes, Clarke Willmott

William Juckes is a partner in the commercial property department of Clarke Willmott.
William has specialised in commercial property throughout his career and has extensive working knowledge of commercial property developments, business acquisitions and disposals, property insolvency work, commercial property lending and large property portfolios. He works for several well known high street names and in particular has vast experience of landlord and tenant work especially on the retail side in the leisure, licensed and food & drink industry.
William is recognised as a leader in his field by Chambers legal directory.

Louise Brown, Clarke Willmott

Louise Brown is a partner in the commercial property department of Clarke Willmott.
Louise specialises in commercial property with an emphasis on portfolio investment and management. She advises on landlord and tenant, leases, options, freehold sales and purchases, portfolio acquisitions and disposals, and development. She handles property investments for institutional and property companies. Louise has also acted for banks and lenders in connection with secured lending.
Louise is a former national chairman of the Association of Women in Property and is still an active committee member for both the national and local committees. She is also a fellow of the Faculty of Building.

Rupert Jones, Weil, Gotshal & Manges

Rupert Jones is a senior European Counsel and leads the London Real Estate team at Weil, Gotshal & Manges.
Rupert has specialised in real estate work since qualifying in 1978, and became a partner with Allen & Overy over 20 years ago. He joined Weil, Gotshal & Manges in 2002 as senior European counsel to lead the London Real Estate team.
Rupert's breadth of work includes considerable experience acting for institutional lenders and other investors in real estate, advising on the property aspects of private mergers and acquisitions, advising administrators, receivers and other insolvency practitioners on all aspects of real estate issues and financial experience ranging from due diligence in respect of secured property assets to the real estate aspects of securitised transactions such as on Canary Wharf.
Rupert was awarded "Property Lawyer of the Year" by Legal Business for his work on the sale of the Canary Wharf development by the banks who had become the equity owners of this development following the exit from administration of Olympia & York.
Rupert was elected chairman of the City of London Law Society’s Planning and Environmental Law Committee in December 2005 having been a member of the Committee since 1997.
Rupert is on the consultation board for PLC Property.

Carrie Faller, Trowers & Hamlins

Carrie Faller is a partner in the Commercial Property department of Trowers & Hamlins.
She has a wide range of commercial property experience, in particular with the purchase sale and management of shopping centres and property portfolios for institutional and overseas investors. She is regularly involved in the property aspects of corporate transactions and also landlord and tenant issues (acting for both landlords and tenants). She also has experience in the creation and use of limited liability partnerships for the purposes of joint ventures for both public sector and private bodies.

Yvette Bryan, Trowers & Hamlins

Yvette Bryan is a solicitor in the Commercial Property department of Trowers & Hamlins.
Yvette has a range of commercial real estate experience including acquisitions and disposals, landlord and tenant transactions and property aspects of corporate transactions and deals primarily with office, retail and industrial premises and hotels.
Yvette leads teams in a wide range of secured lending transactions acting for banks in relation to individual properties and portfolios in the context of both new acquisitions and refinancing of existing debt.
Yvette's clients include institutional investors, property funds, banks, overseas investors, property companies and developers.
