The Employment Appeal Tribunal has held that a tribunal had been entitled to consider the description of activities in contracts when deciding whether activities carried out by an incoming service provider were fundamentally or essentially the same as those undertaken by the outgoing provider for the purposes of the Transfer of Undertakings (Protection of Employment) Regulations 2006 (SI 2006/246).
