Can I comment on your answer to Ask PLC query, If access to and from property can only be achieved over common land, can the necessary rights be acquired by prescription?

I'm not sure the piece on prescriptive rights and common land where the land owner is the local authority (Ask PLC query, If access to and from property can only be achieved over common land, can the necessary rights be acquired by prescription?) is quite complete as there may be a question mark over capacity. That may be something buried in the Local Government Act 1972.

Sorry I can't be more helpful - but from memory it is by analogy with the Putney or Wimbledon case from a couple of years ago.
